Death penalty sought for man who raped, killed 84-year-old

The Orange County District Attorney's Office announced Monday it will seek the death penalty against a 26-year-old Los Angeles man charged with raping, torturing and killing an 84-year-old woman in her Anaheim home.

Anthony Darnell Wade, who was indicted April 22 for special- circumstances murder, was eligible for the death penalty, but prosecutors did not announce until today whether they would seek it.

Wade allegedly broke into the widowed Bessie Whyman's home early Jan. 10, 2010, tied her up, beat her up, raped her and stabbed her to death before ransacking her home and stealing her car and purse, according to the Orange County District Attorney's Office.

Wade was caught after trying to use Whyman's credit card at a Food 4 Less grocery store, according to prosecutors. He got into a fight and was pepper-sprayed when a store employee rejected the card, according to the District Attorney's Office.

Store employees detained Wade for San Bernardino police, who asked local police to check on Whyman when they determined she lived there, according to prosecutors.

Anaheim police found the woman's body in her living room and later arrested Wade.
Wade, who was denied bail, is next scheduled in court April 1.
